Ministries and Ministry-equivalent Organizations
Article 23. Position and role of Ministries and Ministry-equivalent organizations
Ministries and ministry-equivalent organizations are elements of the Government machinery, which act as Chiefs of staff for the Government and execute macro management in their respective sectors throughout the country.
Article 24. Organization of the machinery of the Ministries and the Ministry-equivalent organizations
Ministries and Ministry-equivalent organizations are composed of the Offices of the Ministries and Ministry-equivalent organizations, departments, divisions, institutes and technical units, which are defined by the Decrees of the Prime Minister.
Article 25. Organization of Ministries and Ministry-equivalent organizations .
Ministries and Ministry-equivalent organizations consist of Ministers or Heads of Ministry-equivalent organizations, Vice-Ministers or Deputy-Heads, Heads of the Minister's Office, Deputy-Heads of the Minister's Office, Heads of Departments and Deputy-Heads of Department, Heads of division and Deputy Heads of division, Heads of Institutes and Deputy-Heads of Institutes, Heads and Deputy-Heads of technical units and technical staff.
Article 26. Rights and duties of Ministries and Ministry-equivalent organizations
Ministries and Ministry-equivalent organizations have the following rights and duties:
- to study and draft policies and strategic plans for their respective sectors to be submitted to the Government;
- to study and translate policies, plans and decisions of the Government into programmes and detailed projects in the sectors for which they are responsible;
- to propose to amend or draft laws, Presidential acts, Presidential decrees, decrees to the Government; to issue agreements, instructions, suggestions and circulars in order to support the execution of macro management in their respective ministries;
- to monitor and manage the vertical line activities and personnel of their respective sectors, by collaborating in a unified manner with the local administrations;
- to train the personnel in their respective sectors;
- to organize and manage foreign relations as authorized by the Government;
- to supervise and summarize the implementation of activities in their respective sectors and report to the Government and the Prime Minister;
- to exercise all other rights and other duties specifically assigned by the Government and as stipulated by the Constitution and laws.
Article 27. Role of Ministers and Heads of Ministry-equivalent organizations
Ministers and Heads of Ministry-equivalent organizations are members of the Government as Heads of the sector, and assist the Government in the macro-management of their respective sectors.
Article 28. Rights and duties of Ministers, Heads of Ministry-equivalent organizations.
Ministers and Heads of Ministry-equivalent organizations have the following rights and duties:
- to develop and implement the decisions of the Government meetings in their respective sectors;
- to guide, manage and supervise the implementation of activities in their respective sectors;
- to issue agreements, instructions and circulars in order to raise the efficiency of the management in their sectors;
- the right to suspend or abolish the implementation of agreements, instructions, suggestions and circulars of the lower level of organizations under their responsibility. They also have the right to propose amendments to, suspend or abolish the implementation by, or juristic acts of, other organizations or local administrations which are in contradiction with the regulations and principles of their respective sectors or in contradiction with the laws;
- to decide on the necessary measures to be taken in order to implement the annual plan;
- to submit proposals or draft laws and draft Presidential acts, Presidential decrees and decrees related to their respective sectors, to the Government;
- to appoint, transfer or remove the Deputy Heads of Minister's offices, Deputy Director General of departments, Heads of divisions and Deputy Heads of divisions, Heads and Deputy Heads of units. Also, to appoint, transfer, or remove the Chief and Deputy Chief of the provincial department and Head of Office at the district level through discussion with local administration authorities;
- to assign particular tasks to Vice-Ministers, Deputy-Heads of the Ministry-equivalent organizations; to assign one of the Vice-Ministers or Vice-Presidents of Ministry-equivalent organizations to act as Minister or Head when they are absent or unable to perform their duties;
- to cooperate and sign agreements and conventions with foreign countries, as authorized by the Government;
- to resign from his/her position when he/she finds him/herself unable to execute his/her duties for health or other reasons;
- to exercise all other rights and duties as assigned by the Prime Minister or as stipulated by the Constitution and laws.
Article 29. The roles of Vice-Minister and Deputy Heads of Ministry-equivalent organizations
The Vice-Minister and Deputy-Heads of Ministry-equivalent organizations have the role to assist the Minister and Head of Ministry-equivalent organizations in monitoring and supervising general work of the Ministry, Ministry-equivalent organizations, and responsiblity for specific tasks assigned by the Minister and Ministry-equivalent organizations.
The term of office of the Vice Minister and Deputy Head of the Ministry-equivalent organizations is equivalent to the term of the Government.
Vice-Ministers and Deputy-Heads of Ministry-equivalent organizations should resign from their position when they find themselves unable to execute their duties for health or other reasons;
