The structure, duties and responsibilities of the Government
Article 5. Structure of the machinery of Government
The machinery of the Government of the Lao People's Democratic Republic consists of the Prime Minister's Office, ministries and ministry-equivalent organizations, approved by the National Assembly.
The organization of the machinery of Government should reflect the real needs of the country at any given time.
Article 6. Structure of the Government
The Government is composed of the Prime Minister, Deputy Prime Ministers, Ministers and Chiefs of the Committees equivalent to the ministry.
Article 7. Rights and duties of the Government
- to implement the Constitution, laws and resolutions of the National Assembly, state decrees and acts of the President of the Republic, organize the dissemination of laws, inculcate respect of laws in the public's mind, and define measures to protect the rights and legitimate interests of the people.
- to map out strategic plans for socio-economic development and the fiscal year and submit them to the National Assembly for consideration and approval;
- to collectively execute the management of infrastructure, the expansion of economic bases, culture and society, science and technology, fiscal and monetary policies, and to manage and ensure the efficient use and protection of the property of the state and collective and individual property, as stipulated in the Constitution and laws;
- to report on its own activities to the National Assembly, and the standing committees of the National Assembly, prior to the National Assembly organizing the Congress and reporting to the President.
- to study and submit draft laws to the National Assembly for adoption and draft acts to the standing committees of National Assembly for consideration,
- to study and submit draft presidential decrees to the President for approval.
- to issue decrees and decisions on state management, socio-economic management, science and technology, human resource development, protecting and using the environment and other natural resources; defense and security, and foreign affairs;
- to organize, lead, manage, and supervise the work of various sectors and local administrations to ensure efficiency and with regard to the law;
- to ensure all people are treated equally by the laws of the country;
- to strengthen and supervise national defense, security and public order, build the people's armed forces, implement the decisions on military conscription, and define necessary measures to defend the country;
- to suspend or rescind decisions and instructions, suggestions and circulars of the ministries, the ministry - equivalent organizations, and other agencies under direct authority of the government, and local administrations, if they run counter to the laws;
- to create or abrogate districts and to define the boundaries of districts and municipalities in accordance with proposals of Governors and City Mayors;
- to organize, conduct and monitor state inspections in order to counter the violation of laws and corruption and other weaknesses, and resolve the people's complaints and petitions with regard to illegal activities of civil servants and state management authorities at each level, as stipulated by law;
- to cooperate, negotiate, and sign treaties and agreements with foreign countries, manage and supervise foreign affairs and the implementation of the signed treaties and agreements;
- to exercise other rights and execute other duties, as stipulated by the Constitution and laws.
